4. HOW TO ENTER: There are (2) ways to enter the Sweepstakes.
1. Internet/wireless entry: The Promotion consists of an Instant Win Game and a Sweepstakes. To play the Instant Win Game and enter the Sweepstakes, go to the Website during the Promotion Entry Period. Eligible Participants will be required to log in with their email address and password. If you choose to enter the Promotion via a smartphone, iPad, or tablet (which is not necessary to enter the Promotion), standard carrier-specific wireless rates and all applicable taxes apply depending upon the entrant's wireless pricing plan. Other carrier-specific rates and applicable taxes may also apply in accordance with entrant's wireless customer agreements. There will be (3) Instant Win Game levels available to be played (each, a "Level"). To play any Level, you must do the following:

Mail-in entry: Complete the Official Entry Form in the direct mail piece by confirming your name, address, and telephone number and signing your full legal name to certify that you are a smoker, 21 years of age or older, and send it to the address indicated to receive one (1) Entry into the Sweepstakes Random Drawing for a chance to win the Sweepstakes Grand Prize or complete an Official Entry Form available (while supplies last) at select retail locations by confirming or hand-printing your name, address, birth date and telephone number and signing your full legal name to certify that you are a smoker, 21 years of age or older and send it to the address indicated to receive one (1) Sweepstakes Entry into the Sweepstakes Random Drawing for a chance to win the Sweepstakes Grand Prize. Mail-in entries must be postmarked by July 31, 2018, and received by August 7, 2018. Sponsor is not responsible for lost, late, misdirected, incomplete, stolen, damaged, illegible, or postage-due entries or mail. An original Official Entry Form must be used to enter the Sweepstakes via the mail-in method of entry; no copies or mechanical reproductions of entry forms will be accepted. All Official Entry Forms must be signed certifying that you are a smoker, 21 years of age or older.
All Instant Win Plays must be received and recorded during the Promotion Entry Period. LIMIT: One (1) Instant Win Play that may result in up to two (2) additional Instant Win Plays if Eligible Participant is an Instant Winner, (1) Sweepstakes Entry per day, and additional Sweepstakes Entries if Eligible Participant advances to additional Levels as set forth in Section 4 of the Official Rules. LIMIT: Two (2) mail-in Sweepstakes Entries per Promotion Entry Period. The number of Instant Win Prizes available to be won will decrease during the Promotion Entry Period as Instant Win Prizes are awarded and claimed. Sponsor's server is the official time-keeping device for this Promotion. If an Eligible Participant fails to execute an Instant Win Play on a given day for any reason, such Eligible Participant forfeits such Instant Win Play for that day. A given Eligible Participant's Instant Win Plays for one (1) day cannot be saved or combined with such Eligible Participant's Instant Win Plays for any other day; each day's Instant Win Plays by a given Eligible Participant is a separate and independent event. Further, different Eligible Participants cannot combine their Instant Win Plays in any way. Use of computer programs and other automatic means to submit an Instant Win Play more than once per day is prohibited. Any attempt by any person to submit more than one Instant Win Play per day using multiple/different registrations or any other methods will void all of that person's Instant Win Plays. SWEEPSTAKES RANDOM DRAWING/SELECTION OF SWEEPSTAKES GRAND PRIZE WINNER: All eligible Sweepstakes Entries received during the Promotion Entry Period will be combined and (1) Grand Prize winner will be selected in a random drawing from among all eligible Sweepstakes Entries received. Odds of winning the Sweepstakes Grand Prize depend on the number of eligible Sweepstakes Entries are receiving during the Promotion Entry Period. The Grand Prize random drawing will take place on or about August 14, 2018, by the Administrator, Arrowhead Promotion & Fulfillment Co., Inc., an independent judging organization whose decisions on all matters relating to this Promotion are final and binding in all respects. Total ARV of Package: $44,599.00.

Taxes are the sole responsibility of winner. The difference in value as stated herein and value at time of prize notification, if any, will not be awarded in cash or otherwise.
Grand Prize winner must be a licensed driver, and must present a current valid U.S. driver license and proof of insurance prior to taking possession of the Motorcycle (as required by the regulation in the state where Grand Prize winner resides); failure to show same may result in Grand Prize forfeiture and selection of an alternate potential winner.
Grand Prize winner is responsible for all associated fees including all title, license, insurance, registration, preparation, applicable taxes or fees, and other fees associated with Motorcycle. All other costs not specifically stated herein as being awarded are the responsibility of Grand Prize winner.
Title of the Motorcycle will transfer to the Grand Prize winner upon acceptance of delivery of the Motorcycle, which must take place no later than (45) days after Grand Prize winner verification, or the Motorcycle may (in Sponsors' sole discretion) be automatically forfeited by the Grand Prize winner. Upon accepting delivery and transfer of title of the Motorcycle, Grand Prize winner hereby acknowledges and agrees that neither Sponsor nor any other person associated with the distribution, development and execution of this Promotion and the Motorcycle, or any of their respective affiliates, parent companies, subsidiaries, directors, officers, employees, and agents makes any warranties, representations or guarantees, express or implied, in fact or in law, relative to the use or enjoyment of the Motorcycle, including, without limitation, its quality, mechanical condition, merchantability or fitness for a particular purpose. By accepting delivery and transfer of title, Grand Prize winner is accepting the Motorcycle "as is."

The Grand Prize winner is solely responsible for all federal, state and local taxes. Prize is not transferable. No prize substitution. Reporting and payment of any applicable federal, state and local taxes is the sole responsibility of the Grand Prize winner. The Grand Prize winner may be required to provide Sponsor with their Social Security numbers for tax purposes. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for any recipient who receives a prize if the annual aggregate value of the prize received is $600 or more. Sponsor will issue a Form 1099-MISC to the Grand Prize winner for the total fair market value of prizes received.

6. GENERAL CONDITIONS: By participating in the Promotion, (a) Eligible Participants agree that Sponsor, its parent, affiliates, subsidiaries, production and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents (collectively, the "Released Parties") are indemnified, released, and will be held harmless by Eligible Participants from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of any prize or Eligible Participant's participation in this Promotion or any Promotion-related activity; and (b) Winners grant (and agree to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor's authority the right to the use of Winner's name, photograph, likeness, voice, image, statements, and biographical information at any time or times for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web, without review, notification, approval, or additional compensation, unless prohibited by law. All Eligible Participants are subject to age-verification and confirmation that they meet the eligibility criteria set forth in Section 1 above. Notwithstanding anything to the contrary in Section 4, an Eligible Participant is not a winner of any prize, even if a winning prize message or any other aspect of the Promotion should so indicate, unless and until the Eligible Participant's eligibility and the potential winning claim have been verified. If, for any reason, the Promotion is not capable of being conducted as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion and randomly determine Instant Winners from eligible, non-suspect Instant Win Plays received prior to action being taken or as otherwise deemed fair and equitable by Sponsor. No more than the stated number of prizes will be awarded. If the number of awarded prizes equals the number of prizes offered, no additional prizes will be awarded or provided in connection with this Promotion. In the event more prize winner notifications are issued, or more winning claims are received, than the number of prizes set forth in Section 5 of these Official Rules due to computer, printing, seeding, human or other error or problem, a random drawing will take place from among all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules. BINDING ARBITRATION: The decisions of the Sponsor and the Administrator are final on all matters relating to the Promotion including, without limitation, the construction, validity, interpretation and enforceability of these Official Rules. Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS ("JAMS Rules and Procedures") then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply North Carolina law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. By registering on the Website, Eligible Participants agree to be added to the Sponsor's mailing distribution list.
