really mad and frustrated, and need advice

Ok first I hate the fact that I am even typing this. 2nd i hate the fact that I even give this evil lady a 2nd thought. Yes I'm talking about my landlord. Or should I say ex landlord.

So we moved out. My mom and I spend a week cleaning that house. Scrubbed the floors 3 times, etc. We didn't do the windows or the curtains, didn't realize we were sopposed to.
Well anyways our landlord tells us we aren't getting any money back from our $795 deposit.
She tells us that there was so much she had to fix, etc. One of the main things was that there was 50 nails in the walls, and she has to repatch them. Well first off, she told us before we moved in we werent allowed to put nails in the wall. That was the one thing we were able to not do. Well guess what. Those nails were already there when we moved in, and she is blaming us for them. Shes either a liar, or her old age is catching her.
I would like to ask her for a copy of the previous renters, to make sure their copy says anything about nails being in the house. I bet it does.
I am so angry, upset, sad, I feel taken advantage of.
One of the things is I went over there to get my mail, and every bush, that was in the front yard, is totally dug up and pulled out. Plus the carpet that was in the porch is pulled out. plus the fact that I didn't want to repaint the house till we moved out, she charged us for that (before). And now shes going to charge to repaint agian.
Ughh. most of this stuff is things she decided to do that had nothing to do with us.
Yea there was some writing on the walls from kailey. Or dirt marks or something. But the stupid place needed to be repainted anyways because the paint was peeling.
I don't know but I do think we should get some money back, its not fair.
And I think I am being pretty nice. Because she was sopposed to tell us before we moved in that there was lead paint in the house. And she didn't. Then when we tried to get her to fix it, she wouldn't. I bet she wont even tell the next renter, that there is lead paint there.
I really feel like screaming. Thanks for letting me vent.
 
she has to give you an itemized list of what she is charging you for. in most cases painting is considered normal wear and tear and they have to repaint before new tenants move in. That's for normal wear, not writing on the walls. Short of taking her to small claims court there probably isn't a whole lot you can do. Small claims isn't expensive. I would look into if I were you. She sounds like a nasty woman.

Yea she is sopposed to be sending us a list. She is a christian counslor. Makes $50 an hour, plus rents 5 houses out. She makes 3 times or more the money we do. Probably alot more. Especially since right now its just rocky working for papa johns.

I really just want to right her a mean letter. But then Im kind of scared she will find some way to get me introuble for it.
Basically as everyone says, "Shes set in her ways". She is like 60 or 70 years old. THinks everyone should work, and clean, and know how to do everything.
Rockys been mowing her lawn, and she pays him $30. She just dropped it to $25. And she actually said, she wasn't going to pay him anymore, if he is going to do a minimal job.

She never said that stuff before. :nono: :scratch:
 
Tiff, sounds like she is a witch...I wish you would have taken pictures when you moved in and when you moved out ~ that might have been the only way to really prove anything...I guess you could always call 'Judge Judy'...let her have a shot at her!!
 
Didn't you post about a previous landlord problem? And back then, wasn't it primarily your own fault for not keeping the place clean to begin with? You need to realize that you are renting property from someone else. You need to maintain that property while you are renting it. The best thing you can do now is to either just clean/repair the place according to her wishes for a deposit return, or else just lose the deposit.

The next place you move into, you need to read and understand the fine print of any lease you may have to sign. If you have questions you should ask them before signing any lease agreement. You should inspect the new place before moving in, and notice the condition of the place. Take pictures, write down problems you see...and bring them to the new landlord's attention before signing any rental agreement. Doing all this will only serve to protect you in the event of any future problems you may encounter.

As a small-time landlord myself, I've had my share of tenants who think that the place they rent is not theirs, so they don't care what they do to the place...and then expect their deposit back when they move out. It doesn't work that way. Not with me. I am very fair to my tenants...I read the lease agreement with prospective tenants before they sign anything. This gives them the opportunity to ask questions. It costs landlords a lot of time and money to have to repair/renovate rentals before putting them on the market again.
 
I was lucky to rent from a wonderful couple when we had to rent, we left the place as good as it was before we moved in, this with two little ones. I did let them know when I found problems (the dishwasher never did work, I didn't want them to fix it, I just didn't want them to think that we broke it) and if for some reason we were late with our rent payment (one time 3 days due to holiday) I let them know! We kept our yard perfect and even offered to buy the property from them.

They were good to us, and I feel that we were good to them. I think it is a two way street! It is sometimes hard renting to young couples ~ we could have been hard partying kids with kids, but we weren't! It is a big risk and I realize that from the property owner's point of view also!

The lady that we rented from did get a big kick out of us when she came up on the porch one day and saw little Nerf footballs in all four corners of the porch ~ I had to explain that we had barnswallows building on the porch and that they were attacking us when we went out the door :laughing:
 
tiff, I don't know about the nails but I'm sure crayon on the walls and dirt marks were not appealing to her. If I was the next possible tenant I'd probably take one look and move on. I'm only trying to be fair here...did you tell her you planned on painting the place so she wouldn't have to? Maybe she thought you guys weren't planning on painting. And what about the carpet? Was it beyond just cleaning? Were there juice stains, dirt stains, or any other stains that made it unsightly that were caused by you three? I only ask because I know your dislike of cleaning.

New carpet and paint for the entire rental isn't going to be cheap. She's more than likely going to have to hire someone(s) to do the painting and installing the carpet as well.
 
I dont know what its called. I just said carpet. Because thats the only thing I could think of. Its that green stuff that people put on thier porches. Its like plastic carpet or something.

We kept the lawnmower in there,

I changed my name back, too much confusion with the handicapped rights group. Tiff, make sure you mention the lead paint when you file a complaint and include copies of any documentation.

thanks I sent a complaint in. THey should talk to her tommorrow. Thats what it says on the updated response system.

I did finally sleep good the next night. lol that day I had a long argumentive phone call with my landlord. And ohhh it felt good to get it all out. I was nice, didn't lose my temper, and was actually quite mature about it. I think I got my point across good to her. Where before I would have probably ended the phone call crying.
