During the Promotion Period, purchase any CHEETOS® brand product and look for a uniquely-shaped CHEETOS® snack.
Take a photo of the uniquely-shaped CHEETOS® snack (“Photo”). Next, visit CheetosWinWhatYouSee.com (“Website”) and follow the online instructions submit your Photo and title of your CHEETOS® snack.
Altogether, the Photo and title shall hereinafter be referred to as the “Entry”.

To enter without making a purchase, visit the Website, choose any CHEETOS® snack photo provided in the photo gallery and follow the online instructions to provide a title of the CHEETOS® snack photo you selected (also, an “Entry”) and submit your Entry.

By submitting an Entry, participant agrees that the Entry conforms to these Official Rules and the Entry Guidelines specified in Section 4, and that Sponsor may disqualify participant from the Promotion if it believes, in its sole discretion, that the Entry fails to conform to such guidelines.

Limit (50) Entries per person/email address per day. Entries will be judged to determine (1) Entry Period Prize winner for each Entry Period. See Sections 5 and 6 for Judging Criteria.

Additionally, (1) Random Drawing Prize winner, for the entire Promotion Period, will be determined via a random drawing. For each eligible Entry (defined above) submitted, participant will automatically receive (1) entry into the random drawing. See Section 7 for random drawing details. All Entries must be received and recorded within the Promotion Period.

If the Sponsor, in its sole discretion, determines the CHEETOS® snack was altered in any way or the Photo was manipulated in any way, participant may be disqualified, even if he/she was previously announced as a prize recipient. Do not use any image-editing techniques or related software or app to manipulate the Photo.
Sponsor reserves the right to require a potential winner submit to a confidential background check to confirm eligibility and help ensure that the use of any such person or Entry in advertising or publicity for the Promotion will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion as determined by Sponsor, in its sole discretion. The background check may include (a) the review of a potential winner’s social media accounts; and/or (b) the review of the original Entry submitted and all related files. ENTRY GUIDELINES: By submitting an Entry, you agree that your submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, and that Sponsor is free to disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. Sponsor reserves the right to, and may or may not, monitor/screen Entries.By submitting an Entry you warrant and represent that: (a) you have read or have had these Official Rules read to you and you are in agreement with these Official Rules; (b) it is your original work, (c) it has not been previously published, (d) you have received permission for the use of the image/likeness of any and all identifiable persons who appear in your Entry and it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that you have obtained permission from any person whose name, likeness or image is used in your Entry; and (f) that publication of the Entry via various media including Web posting, will not infringe on the rights of any third party rights. 5. INITIAL MODERATION AND JUDGING: At the conclusion of each Entry Period, Entries will be reviewed by a moderator selected by Sponsor who shall score Entries on a scale of 1 to 5 based on the following judging criteria: 50% “How well does your CHEETOS® snack shape match its title?” and 50% “How unique is your CHEETOS® snack shape?”. All Entries receiving a score of a “4” or “5” shall advance to the Second Round of Judging.
Note: Any “likes” for a particular Entry as shown on the Website are unrelated to the judging criteria and will not impact the judging (either round) in any manner.

6. SECOND ROUND OF JUDGING: For each Entry Period, all Entries which have advanced to the Second Round of Judging (as stated in Section 5) will be scored on a scale of 1 to 5 by Sponsor’s marketing agency and/or Sponsor based on the following judging criteria: 50% “How well does your CHEETOS® snack shape match its title?” and 50% “How unique is your CHEETOS® snack shape?”. The participant whose Entry receives the highest score as awarded by the judges in the Second Round of Judging will be deemed the Entry Period Prize winner for that Entry Period (regardless of the period in which it advanced to the Second Round of Judging). In case of a tie, tied Entries will be re-judged by two (2) new judges (based on the judging criteria stated herein) to determine the winner of the tie.

7. RANDOM DRAWING: One (1) Random Drawing Prize winner will be drawn on or about September 4, 2018 from all eligible Entries submitted during the Promotion Period. Odds of winning the Random Drawing Prize depend on the number of eligible Entries received throughout the entire Promotion Period. The random drawing will be conducted by an independent judging agency designated by Sponsor, whose decisions are final in all matters relating to the random drawing.

8. PRIZE DETAILS:

Random Drawing Prize: (1) Random Drawing Prize will be awarded for the Promotion consisting of $11,112.00, awarded in the form of a check, payable to winner.

Applicable to “Trip” Entry Period Prizes: A trip prize may include air transportation for winner and up to three (3) guests, quad-occupancy hotel accommodations for the appropriate number of nights, event tickets (if any), and spending money (if any; amount to be determined by Sponsor based on remaining budget after transportation, accommodation, and/or event costs have been determined). Travel, accommodations, and/or events are subject to availability and change. Ground transportation, meals, gratuities and all other expenses not specified herein are solely winner’s responsibility. All travel subject to availability, government restrictions and regulations, hotel, airline, airport or other transportation terminal (or other types of transportation) restrictions and regulations. Other restrictions may apply. Selection of airline, ground transportation, and overnight accommodations, are at Sponsor’s sole discretion.

Winner will be required to provide a credit card prior to check-in and is solely responsible for all incidental charges and may be required to sign an additional liability release for the use of the accommodations. Sponsor assumes no responsibility for canceled, delayed, suspended or rescheduled prize-related activities (including, but not limited to any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, or prize providers) beyond its control. In the event the winner and/or a guest misses a scheduled airline flight (through no fault of Sponsor or due to Force Majeure), Sponsor will have no liability for any costs associated with changing or rebooking transportation. Additional prize award details and travel information to be provided to the trip winner at the time of notification. Winner must be able to travel on dates specified by Sponsor or prize will be forfeited. Winner and his/her guest(s) are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Winner and guest(s) must have all necessary identification and/or travel documents (e.g. passport or valid driver’s license) required for travel. Winner and guest(s) must travel on the same itinerary.

Any minor guest (under age of 18; 19 in AL or NE) must be accompanied at all times by minor's parent or legal guardian who must be the winner or one of winner’s guests. Guest(s) (or if a minor, his/her parent or legal guardian who must be the winner or one of winner’s guests) must complete and return a Liability/Travel Release prior to making travel arrangements. Actual value may depend on city/date/time of departure. All trip prizes must be completed by August 31, 2019.

Applicable to “Experience” Entry Period Prizes: Experience prizes may or may not include a Trip (see above for information applicable to a Trip prize). Event tickets are subject to terms and conditions specified thereon. If applicable, seat locations will be determined by the Sponsor, in its sole discretion. Events are subject to availability and change. Any expenses not specified herein are solely winner’s responsibility.

Applicable to “cash” prizes: Any cash prize or cash portion of a prize (spending money) shall be awarded in the form of a check, payable to winner.

Winner must accept prize as stated by Sponsor or prize may be forfeited and awarded to an alternate winner. Any difference between stated value and actual value will not be awarded. Total ARV of all prizes is $100,000.00.

Limit (1) prize per person.

9. NOTIFICATION OF POTENTIAL WINNERS: Prizes won by an eligible participant who is a minor in his or her state of residence will be awarded to a minor’s parent or legal guardian. Potential winners will be notified by phone and/or email and will be required to respond to the notification within (24) hours in order to capture the potential winner’s contact information. Following the initial notification period, potential winners will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release (collectively, the “Affidavit”) within forty-eight (48) hours via fax, email and/or overnight mail.

If you are determined to be a potential winner and you submitted a photo of a CHEETOS® snack you purchased in the winning Entry, Sponsor reserves the right to send you a box and instructions (altogether, the “Box”) on how to carefully package and mail in your CHEETOS® snack. The CHEETOS® snack you send in must be the same CHEETOS® snack appearing in your winning Entry/Photo. All submitted CHEETOS® snacks become the property of Sponsor and will not be returned. Your CHEETOS® snack submission must be received by the Sponsor’s agency within three (3) calendar days of the delivery date of the Box at your residence (as documented by the shipping company). For your protection, it is suggested that you send in your CHEETOS® snack exactly as instructed and keep photos of your CHEETOS® snack and you packing the Box for your records.

Sponsor and its agencies are not responsible for suspended or discontinued wireless or Internet service which may result in a potential winner not receiving an initial prize notification; nor is Sponsor responsible for any change in participant's email address, mailing address or phone number or a delay in the delivery of the Box required to return the CHEETOS® snack. If (i) an attempted notification is returned as undeliverable, (ii) a potential winner cannot be verified, (iii) any required documents or Boxes with CHEETOS® snacks are not received by Sponsor’s agency within the required timeframe, or (iv) a potential winner is otherwise unable to accept the prize as stated, the applicable prize may be forfeited, in Sponsor’s sole discretion. If any prize is returned as undeliverable, prize will be forfeited and Sponsor shall have no further liability to award that prize.

By accepting a prize, each winner agrees that his/her Entry will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Entry, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Each winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that a winner may now or later have to his/her Entry. Sponsor reserves the right to alter, change or modify the winning Entry, in its sole discretion. Upon request of Sponsor, each winner shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Entry and of the copyrights transferred and “Moral Rights of Authors” waived under these Official Rules. Sponsor and Promotion Parties are not liable in the event that any portion of the Game is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”).

8. GENERAL CONDITIONS: Winners are solely responsible for any federal, state and/or local taxes on an Instant-Win Prize, if any. No cash equivalent or substitution of an Instant-Win Prize or Digital Photo Download is offered, except at the sole discretion of the Sponsor. Any difference between the stated approximate retail value and the actual retail value will not be awarded. No transfer of an Instant-Win Prize or Digital Photo Download is permitted. Instant-Win Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor, except manufacturer’s standard written warranty included in the Instant-Win Prize packaging. Unclaimed Instant-Win Prizes and Digital Photo Download will not be awarded. If an Instant-Win Prize or Digital Photo Download, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute the Instant-Win Prize and Digital Photo Download with another Instant-Win Prize or Digital Photo Download of equal or greater value. If for any reason the Game is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, Sponsor reserves the right, at its sole discretion, to (a) disqualify any individual who is responsible or who tampers with the submission process, and (b) cancel, modify or terminate the Game. In the event of cancellation, Sponsor will randomly award the remaining Instant-Win Prize(s) and/or Digital Photo Download among all eligible, non-suspect Plays received prior to cancellation. This Game is offered only in the United States and is governed by the laws of the state of Texas, and all claims must be resolved in the federal or state courts located in Collin or Dallas counties, Texas.

Additionally, any communication between participant and Sponsor or its agencies regarding this Game (e.g. phone calls, text messages, chats, email, etc.) may be recorded for quality assurance and training purposes.
