Verizon using deceptive advertising for their prize?

I recently won a 55 inch 3D tv from Verizon Sweeps with ARV $2260.00. When speaking with the prize company about the prize, they said the tv they were going to provide was not available so they gave me a different model. Well, the model they gave me was $800 less than the AVR.

I feel they have pulled some deceptive practice with the prize. There was no specific tv model listed in the rules, just the generic description, but with AVR of $2260, the price of the tv would indicate it is a higher end model. At the time they ordered my prize, there were tvs that fit the description for that ARV. I am now fighting with them to get the difference in a gift card from Best Buy where they ordered the tv. Has something like this happened to anyone else. They have said that my tax form would indicate the lower value.

The rules state they can subsititute prize for equal or greater than ARV. They claim it is the 55 inch tv that is the prize value not the ARV. Look at it this way, for instance if they said the prize was a car for $22,060 and they said that car wasn't available, per their explanation they could give me a car for $1000 and they would say they are within the rules.

ARV's are *usually* based on when they begin/set up the sweeps, so they reflect the price at that time.

Since they did not give a specific make/model, just general info, and they sent a 55 inch 3D tv, they fulfilled IMHO. They adjusted the 1099 - if they had not, then I would fight them!

I won a laptop from DELL with an ARV of $1500, but over a year later, after being drawn as a 2nd chance winner, when I looked it up, it was only worth $400!!!

I had a similar thing happen with a diamond watch I won - by the time you get the prize, it's no longer the newest thing on the market.

Trip ARV's are notorious for being quite high, to CYA for the sponsor, and account for furthest away travel.
 
As long as you have received the prize described and a new 1099 reflecting that price, then they have fulfilled their obligation. As Amy indicated, especially with electronics the price attached to a prize of the beginning is almost always worth less by the time you receive it.

I could see your argument if they gave a specific model number for tv. They need to change the way thier rules are written. Anyways, l just got word they are going to be offering a gift card for the difference. :)

For some reason that is my forte... I have won one every year from 2006-2011, except 2010. Started entering sweeps in 2005. Each one has been larger than the last. I have won twice from Verizon with instant wins in 2009 and 2011.

I actually won another one earlier in 2011 that I don't count, they just gave me a $1000 gift card to purchase a 3D tv which I used on something else. Congratulations! You have been selected as an instant winner in the “Huddle Up! instant win Game” sponsored by hormel sweepstakes Foods Sales, LLC
 
ARV= Approximate Retail Value

Which means the value is in the ballpark but you don't know if it is the local high school field or the Superdome.

WOWSA!!! Mine was ipods - 6 - 8 of them. That stopped though :crazytongue:
 
To follow up. Ended up getting a Gift Card for $865 which was the difference between the prize received and the ARV. So ended essentially getting a tv and the money to pay the taxes and a little extra spending money. It pays to fight if you feel you were wronged.

I give Verizon credit in the way the eventually resolved this.
