US Weekly gift basket win - and loss. I need wome advise

Okay, so back in April I received an email that I had won this big gift back from US Weekly. (said it was worth aroung $1200) I had to sign an affidavit. And it did mention that I am responsible for all taxes. Faxed it back. and waited. I received a phone call with a recorded message that I would be receiving a package the next day and that someone neeeded to be home to sign for it. I rescheduled a doctor appointment and an MRI. I was at home with my two kids and waited for the UPS man. He neve showed. I understand that the UPS people have alot of packages to deliver, so I figured that he would be by the next day. I am disabled and i can't just "run to the store to get some bread". I can't even drive a car. I was home for 3 days, after I received that message. I called the contact I had for the contest. She gave me the package shipping number from UPS. I went to the UPS site, typed in the number and it showed it had been delivered (the day I was asked to be at home to sign for it). I freaked! I question my kids about a million times and was kinda giving them the thrid degree. I called UPS and after explaining to them about the message I received, they told me that it is the drivers descretion if they ask for a signature or not. WHAT??!! :cussing: I told them that I was expecting a $1200 package. Of course, an investigation as to where the package was dropped off started. Yeah, like a driver is going to know where he dropped off my package out of all the other ones in he truck. :laughing: So, I waited the 3 weeks it takes for the investigation to end. Yesterday I called the contact for US Weekly, she told me that I should expect a check delivered by UPS in a week or so. I thanked her for working with me to come to a resolution. We were about to say our good-byes, then I asked her how much the check was for. She said that it is $100. :hammer: I asked her why it was only $100. She said that UPS said that that is what the package was worth. I called UPS and that is the going rate for a missing UNinsured package. :cussing: I was so mad. Why had US Weekly not insured such a pricey package, or why not give ME the option to insure it with my own money?? This bites and has really questioned wheather or not I want to continue sweeping. I have been doing it for years now, since I became disabled. I have won some really nice things, but I just don't know if my emotional state can handle such a let down again. And to top it off, I am still responsible for the taxes. :cussing:
 
Get an updated 1099 from them for the "new" value of what you actually received. Since you didn't get the full package, I cannot see how you have to pay taxes on it.

Sorry about all the stress.

The first $100 of any package is covered "free" with shipping, hence where the $100 comes from.
 
As I understand it you're not responsible on taxes for something you never got. You're responsible for taxes on the $100 you actually received, that is it. You have proof you never got it, so there should not be a problem. Your tax preparer should know more.
 
I am really sorry to hear this. You are not responsible for the taxes is you do not get the package. Contact the sponsor and ask for an updated 1099 with $100 value declared on it, if they won't make this right you don't have to pay.

I am very sorry this is not working out the way you had hoped. You would think they would do something to correct this. Tell them you are not happy, they might try to fix it
 
What a total bummer! I hope the sweepstakes Gods smile upon you. Don't give up on sweeping...there are so many prizese left for you to win! Good luck with the taxes.

Okay, so I have had some time to think. :scratch: I am a firm believer in the rule of 3 (karma). I called the lady back from US Weekly and appoligized for freaking out on her yesterday. :cussing: She told me she understood my frustration. I explained to her that once the package was handed over to UPS, they are the ones responsible to get the package to me. I tried to explain that to a few mangers of managers at UPS yesterday,. :hammer: Of course, they were not going to take responsibility. One man even tried to pin it on me, by saying, "Some people take advantage of the system...." :whistle: I told him there was no way I could lie about something like that. But, hey, at least I'm going to get the $100 check. That will pay for the late cancellation of the doctor's appointment I had to stay home and wait to sign for the package that never came. :cheers:
 
Wow, I would still follow up with UPS headquarters. You need to demand who authorized to leave that package when it required a signature. Reason is this... we had a UPS man fired in our area for stating packages were delivered when he was the one taking the packages. It was found out by someones security camera on their home. They saw UPS show up come to the door at the exact time the package was "signed" for. Then he picked up the package and left. They investigated and found him with more than just one package. Not saying this is what happened but it sure makes you wonder. If it were me I would go all the way to the top to get some answers. Hope it all works out for you. Hopefully you are blessed with a greater win too!
 
Well I really am sorry for your hard time. Just remember who ever got the package knows it is not theirs, and they should not keep it. In the end of it all they will get what they deserve, as God says we get what we give, (my interpretation) So keep sweeping and smiling, you will have more better wins, from companies that will back up their contest. some companies go beyond the call, and I hope all your future dealings are with them. I'd turn ups into the BBB! I have had some issues with one or two different business' (no contest problems as I am newbie) and they really helped out. They should be held accountable!
