The T-Mobile NBA 2007 Instant Win Game
1. NO PURCHASE NECESSARY TO ENTER OR RECEIVE A PRIZE OR INCREASE CHANCES OF RECEIVING A PRIZE. The T-Mobile NBA 2007 Instant Win Game ("Promotion" or Instant Win Game) begins at 12:00:01 PM Eastern Time ("ET") on Monday, February 12, 2007 and ends at 11:59:59 PM ET on Wednesday, April 25, 2007 (the Promotion Period).
2. ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States, residing in the 50 United States and the District of Columbia (excluding Puerto Rico and all other territories and possessions). Entrants must be 13 years of age or older at the time of Promotion registration. Employees, officers and directors of T-Mobile USA, Inc ("Sponsor"), RealTime Media, Inc. (collectively, the Promotion Entities), their respective affiliates, sales representatives, retailers, dealers, and sub-dealers, Turner Network Television LP (Turner), Wasserman Media Group, The Garrigan Lyman Group, Wong Doody, Publicis, Optimedia, the National Basketball Association (NBA), its member teams, NBA Properties Inc, and NBA Media Ventures, LLC., and the respective affiliates of each such NBA-related entity (collectively, the NBA Entities), the respective promotion, marketing and advertising agencies and contractors of the Promotion Entities, Turner and the NBA Entities, any other entities engaged in the creation, development, manufacturing, production, distribution or sale of T-Mobile services/products or any other entities involved in the creation, development, manufacturing, production or distribution of materials relating to this Promotion, including each such individuals respective immediate family members (i.e., spouses, siblings, parents, grandparents, children, grandchildren, aunts, uncles, and each of their respective spouses, regardless of residence) and persons living in the same household (regardless of whether related) as any of these individuals (together "Employee Entries"), are not eligible to participate in the Promotion. By entering the Promotion, each participant hereby expressly agrees to release, discharge, defend, indemnify and hold harmless the Promotion Entities, the NBA Entities and their respective parents, affiliates, subsidiaries, retailers, and agencies, and each such entitys respective officers, directors, employees and agents, from and against any and all liability, judgments, claims, losses, injuries, demands, damages, actions, and /or causes of actions, whether direct or indirect, which may be due to or arise out of, in whole or in part, participation in the Promotion or any portion thereof, or the acceptance, use/misuse or possession of any prize awarded hereunder, including any travel, prize activities or attendance at any event. These Official Rules and the decisions of the Promotion Entities (as the official judges) hereunder are final, binding and non-appealable in all respects. This Promotion is void in Puerto Rico, all other U.S. territories and possessions, and wherever else prohibited or restricted by applicable law, rule or regulation. All federal, state and local laws and regulations apply to the operation and administration of this Promotion.
3. HOW TO PLAY THE INSTANT WIN GAME: No purchase necessary to enter into, play, or receive a prize under, this Promotion. Any attempt by a person to use multiple e-mail accounts to enter more times than is allowed by these Rules may result in the complete disqualification of such person from participation in this Promotion and from eligibility to receive any prize hereunder, as determined by the Promotion Entities in the exercise of their sole discretion.
First-Time Participants: To enter and play the Promotion, a participant must go to the following Web site address:
http://www.t-mobile.com/nba (the Site) and follow the links to the Instant Win Promotion Registration form. In order then to receive an on-line Instant Win Game Play, the participant must completely enter the correct information in all required fields on the Registration form and click on the Submit button. Upon receipt of the Instant Win Game Play, the participant is able to proceed to play the Instant Win Game, by clicking on one of the three Limited Edition D-Wade Sidekick 3 handset devices shown on the screen. Once the participant has clicked on a device, the results of his/her Instant Win Game Play will be displayed automatically. If the Game Piece displayed on the participants browser indicates that he/she is a potential recipient of a particular prize hereunder, then he/she shall become entitled to receive that prize, subject to confirmation, verification, compliance with each provision of these Official Rules, and final approval from the Promotion Entities.
If a Promotion participant is a potential prize recipient hereunder, then he/she must click on the Redeem Your Prize Now link and completely and correctly fill out the on-line prize redemption form (unaltered from the precise lay-out in which presented to the participant) and click the Continue button. All prizes must be claimed by 11:59:59 AM ET on Thursday, April 26, 2007; otherwise, the potential prize recipient(s) irrevocably and in perpetuity will forfeit any and all rights to claim such prize(s). All prize claims are subject to confirmation, verification and compliance with each provision of these Official Rules. Without verification, any potential prize recipient will not be entitled to become an actual prize recipient hereunder.
Returning Players: Each Promotion participant is required to complete the on-line registration form only the first time that he/she registers for the Promotion. Returning participants in this Promotion can log in by clicking on the returning visitors link on the Promotion Registration page of the Site. To play the Instant Win Game again, the returning participant simply needs to fill in his/her first name, last name and e-mail address on the Log-in Page of the Site and click the Submit button; he/she thereupon will receive one (1) Instant Win Game Play and be able to proceed to play the Instant Win Game in accordance with the instructions set forth above.
Entries in this Promotion will be deemed made by the authorized account holder of the e-mail address submitted at the time of the Promotion entry. In the event of a dispute regarding the identity of any potential prize recipient hereunder, the potential prize recipient shall be deemed to be the authorized account holder of the e-mail address submitted at the time of the Promotion entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. A potential prize recipient must provide the Promotion Entities with satisfactory proof that he/she is the authorized account holder of the e-mail address associated with the potential prize-receiving entry. Entries generated by a script, macro or other automated means shall be disqualified from this Promotion and ineligible to receive any prize hereunder. Promotion entries that are incomplete, illegible, indecipherable, incomplete, inaccurate or corrupted are void and will not be accepted. Information collected from each Promotion entrant is used solely for the purpose of identifying and notifying the potential prize recipients and conducting any random prize drawing(s) hereunder, and such information will not be re-used, sold or shared in any manner by the Promotion Entities or any third parties unless such entrant has elected to receive additional information and promotional material from the Promotion Entities and/or such third parties. Within a reasonable period of time after the conclusion of the Promotion Period, all information supplied by the entrants hereunder will be removed from the Promotion Entities database(s). 4. INSTANT WIN GAME PRIZES AVAILABLE and ODDS OF WINNING: There are a total of nine hundred (900) Instant Win Game Plays that randomly will be selected to receive a prize hereunder. Odds of winning a particular prize hereunder depend on the number of eligible Promotion entries received and the date and time when a particular Promotion participant plays the Instant Win Game. The quantities, description and average retail value (ARV) of each specific prize anticipated potentially to be awarded in the Instant Win Game hereunder are as follows:

The place, date and time of the particular NBA game shall be determined by the Promotion Entities and the NBA Entities in the exercise of their sole discretion. Travel, parking and concessions are not included as part of any NBA game prize. The ARV of each set of two (2) tickets to an NBA game is One Hundred Dollars ($100.00);
(10) Charles Barkley-Autographed or Dwyane Wade-Autographed T-Mobile Basketball. The ARV of each autographed basketball is Two Hundred Seventy-Five Dollars ($275.00);
(30) NBAStore.com $100 Gift Certificates. Each recipient of one of these certificates hereby expressly acknowledges, agrees and understands that he/she shall be bound by each condition, restriction and other provision for/on usage/redemption that is contained on the certificate itself or at any NBA-operated/owned web site or other location that is specified on the certificate. The ARV of each certificate is One Hundred Dollars ($100.00);
(20) T-Mobile Phone Pack: One (1) mobile phone and One Hundred Dollar ($100) in Prepaid T-Mobile To GoSM prepaid wireless phone service. The exact manufacturer and model of the mobile phone shall be selected by Sponsor in the exercise of its sole discretion. Each recipient of one of these phones hereby expressly acknowledges, agrees and understands that his/her T-Mobile To Go prepaid wireless phone service and usage of such phone shall be governed by and subject to (i) each of the conditions, restrictions and other provisions set forth on the prepaid activation card and (ii) each of T-Mobiles Terms and Conditions, a copy of which is located at
www.t-mobile.com. The ARV of each phone, together with One Hundred Dollars ($100) in T-Mobile To Go prepaid wireless service, is Three Hundred Fifty Dollars ($350.00); and,
(810) NBA Gear, to be comprised of one of the following NBA-themed items: (i) one (1) sweatshirt, (ii) one (1) t-shirt, (iii) one cap, or (iv) one (1) headband/wristband set. The exact items (e.g., colors, styles, NBA team logos, etc.) shall be selected by the Promotion Entities and the NBA Entities in the exercise of their sole discretion. The ARV of each such NBA Gear item is Twenty Dollars ($20.00);
The total ARV of all nine hundred (900) prizes described hereunder is Thirty-Four Thousand Nine Hundred Fifty Dollars ($34,950).
NO PRIZE RECIPIENT HEREUNDER SHALL BE PERMITTED TO (A) REPLACE HIS/HER DESIGNATED PRIZE WITH ANOTHER PRIZE OR ITEM, (B) TRANSFER OR ASSIGN HIS/HER DESIGNATED PRIZE TO ANOTHER PERSON, OR (C) REDEEM HIS/HER PRIZE FOR CASH. IN THE EVENT OF THE UNAVAILABILITY (FOR ANY REASON) OF ANY OF THE ABOVE-DESCRIBED PRIZES, THEN SUCH PRIZES MAY BE SUBSTITUTED BY THE PROMOTION ENTITIES FOR ITEMS OF AN EQUAL OR GREATER ARV.
5. PRIZE AWARDING: There is a maximum limit of one (1) Instant Win Game prize hereunder that can be received by each person or e-mail address per day of the Promotion. Each prize hereunder shall be awarded solely upon (a) verification of the particular potential recipient of such prize and (b) final approval by the Promotion Entities. No prize substitution, cash equivalent of prizes, or transfer/assignment of prizes hereunder is permitted, except by the Promotion Entities, who specifically reserve the right, exercisable at any time in their sole discretion, to substitute a prize due to prize unavailability (for any reason), provided that the substitute prize is an item of equal or greater value. Potential recipients of any prizes hereunder shall receive prize notification by means of electronic mail, United States Postal Mail and/or overnight mail (as determined by the Promotion Entities in the exercise of their sole discretion). Each prize hereunder will be fulfilled within twelve (12) weeks after the last day in the month (if ever) in which the particular potential recipient of that prize has been verified. Such verification is an express prerequisite to any potential prize recipient hereunder becoming an actual prize recipient hereunder. If any potential recipient of any prize hereunder cannot be contacted; is ineligible; fails to claim the prize; or otherwise fails to fully comply with each provision of these Official Rules, then he/she will forfeit any and all rights to receive, possess or use that prize, and that particular prize will not be awarded. Each actual prize recipient hereunder hereby expressly grants to the Promotion Entities and the NBA Entities all rights to use and publish his/her name, likeness (photographic or simulated), voice, and city and state of residence for solely advertising, marketing, promotional and publicity purposes in connection with this Promotion, without any form of notice or any amount or kind of compensation, except where prohibited by applicable law. All information collected hereunder by the Promotion Entities will be treated in a manner consistent with the Promotion Entities respective privacy policies. All decisions of the Promotion Entities hereunder with respect to any Promotion-related matter shall be final, binding, and non-appealable in all respects
