Question for SA member's ? Who would complain about this ?

:scratch: Ok. I recieved a Prize from Gilette Young guns promo from FED-EX today.
The problem I have is the prize I recieved I feel I was duped a little bit. The rules say this prize is supposed to be a Drivers "Leather" Jacket worth $200.00. (10) Weekly Prizes (1 of each available to be won each week): Driver Leather Jacket, ARV $200/ea. I recieved a reversible " WOOL" jacket with leather sleaves ?? Not even close to what is considered a Drivers Leather jacket. Even if you look at their main page.. http://www.gilletteyoungguns.com/games/vegas/Default.asp
The main page shows a complete Leather jacket. Not a Wool jacket. The value of the jacket I recieved today is only 130.00 not the 200.00 they stated in rules. I was so excited to think I would get a Complete Drivers Leather jacket and now to be only disappointed with this wool jacket..
Hey I completely understand we as "sweepers" are not supposed to complain about free stuff. But on the other hand we spend lots of hours away from family, friends, work and such to do this hobby. I really don't want to complain it is a nice jacket. But I still feel i was mis-lead about the prize from the picture and value of prize.
My Question is what would you do. Would you complain or atleast let them know your disappointment and confusion about the matter. I went and told everyone I was getting a leather jacket and now I got this wool jacket. I feel like a fool now.
Just to note the Congrats letter says "Enclosed you will find your prize. Please note that due to inventory limitations all sizes are final and exchanges are not permitted." I had no choice of driver or size it was just sent as is.
So please let me know what you think and what you would do or not do. Thanks for your replies. I will take all into consideration before making a decesion on what I will do. And will update what if anything I do about it..

P.s. The jacket is a Denny Hamlin #11 FED-EX wool reversible listed on Nascar Superstore website. They dont even carry a leather for Denny Hamlin.???
 
The prize may have become unavailable when time for fulfillment came up. If you have a copy of the rules, also check to see if there is a clause that says prizes may be substituted if original prize becomes unavailable.

I don't think it would hurt to contact someone and politely explain that you think you received the wrong prize. Someone may have ordered the wrong jacket by mistake.

I understand the disappointment. If it's something you might not use, consider placing a listing in the trade or sell forum here. Someone may want it and it could be a win/win situation.

Sorry you are disappointed. I hope something better comes your way soon! :)
 
I would just inquire about it. Also, keep in mind that they are, per the rules, allowed to substitute the prize for something of equal or greater value; the the ARV's are usually nothing more than over-inflated approximations. In other words, even if you did get the original jacket, chances are that you'd find it selling for much less than the ARV.
 
:wave: So sorry that you didn't get what you expected. It does seem unfair. The only thing you can do is let them know of your disappointment and see if anything happens. In most instances when they can't fulfill the prize described they send something better.
From my own experience of what would I do, I do nothing.Maybe if I was really disappointed I would at least let them know. I am usually just happy to get something! Almost all the ARVs are overinflated prices.

Well thanks for the replies so far, just a few comments. For Wolfie There is nothing in the rules for substituting prizes. I also understand they inflate ARV's of prizes . But this is not even close to the 200.00 jacket if you look them up on the Nascar store there are Real Leathers for 199.99 which is more like it. Then you look up the jacket I got they are 129.99 retail. In the rules it says the actual value of those prizes can fluctuate with market conditions. Prizes cannot be substituted, assigned or redeemed for cash but Sponsor reserves the right to substitute a prize (or portion of a prize) of equal or greater value should a stated prize (or portion of prize) become unavailable.
So my complaint now is the jacket I got is never been priced at 200.00 or even close. It seems pretty obvious to me as a Nascar fan for 18 yrs. what I should of got and what I actually recieved. They rules stipulate for substituion is to be of equal or greater value. I still feel Duped with a wool jacket and not a leather. HUMM ?? Keep replies coming please .. Again I appreciate all your replies..
 
You have to be able to look up the same exact jacket that was originally offered as a prize to find out it's true value. Chances are the leather jacket they were giving as a prize wasn't even close to $200. Maybe, $150 but not $200. That's just from my experience from winning all types of prizes over the past 10 years. The only things I found close or right on to the ARV were iPods and gaming consoles like Wii, Xbox 360, etc.
 
Well I have an Update,
I couldn't take my disappointment last night so I called Gillette promotion director. I nicely explained my confusion and disappointment.
The Promoter tried to somewhat explain what happened. He said the sponsors sent this merchandise to them and thats all they had. But after explaining my point of the picture of the full leather jacket on their main page and the wording of the rules for a Driver's leather and value. He got my point and took the time to research the website rules the picture on main page and looked elsewhere for the jackets. He understood where I was coming from. He proceeded to tell me they didn't make the rules the sponsors did. He admitted to their mistake of allowing sponsor to write the rules.
So they are going to see what they can to do make it right for me. I was cordial about my complaint and truly felt bad about having to call and complain. But I really felt I was mislead by rules, and their picture of a jacket.
So to all who left reply Thank You it helped with my decesion. I will update when I recieve a return call on what the outcome will be.

They have noticed their error on the rules list and website picture. They are going to replace the jacket I recieved with the full leather one I believed I was getting in the first place. So I have helped out 9 other winners. So I guess it pays sometimes to just voice your concern in a polite manner.

I totally agree, voicing your concern in a polite manner is beneficial to both the sponsor and the sweeper :cheers:

I've witnessed where people responded rudely in a similar situation, and the fall out it engendered just reinforced the negative way sweepers are considered by sponsors, and tends to bring out the "geez, just be happy you won" crowd :nono:

Ultimately, it is up to each us to decide for ourselves what we should do when we have a situation where the fullfillment doesn't meet the promise, and I applaud you on your decision, and how you (hopefully) changed this sponsors' opinions of sweepers!!! :laughing:

Yes unfortunately I have to return the other jacket. Believe me I was hoping they would allow me to keep both. But I just want my full leather drivers jacket. This is the 2nd time I haven't got what was offered as a prize and both times the sponsor's made it right. Thanks to all..
