6. Prizes: FIVE (5): Each verified winner shall receive a
Marlboro sweepstakes Ranch trip consisting of a 4-day/3-night trip for (2) to a ranch in the western United States (the “Ranch”) in 2019 (location of Ranch and exact dates to be determined by Presenter at its sole discretion).
Trip package includes round-trip, coach-class air transportation for (2) from a major commercial airport near winner’s and travel companion’s residences (determined by Presenter in its sole discretion) to commercial airport near the Ranch;
(3) nights' accommodations at the Ranch determined by Presenter in its sole discretion (single room, double occupancy);
ground transportation to and from destination airport; meals at the Ranch (menu determined by Presenter in its sole discretion);
and a check for $600 made payable to the winner.
Approximate Retail Value ("ARV") of each Grand Prize: $4,890.
All travelers must present a valid, government-issued photo ID upon arrival at the Ranch.
A valid, unexpired driver's license may be required to be eligible to participate in certain activities at the Ranch.
Winner must agree to depart and return on dates specified by Presenter and attend the Ranch location specified by Presenter.
If winner cannot travel on dates specified, prize may be forfeited. Notwithstanding the foregoing, Presenter will make reasonable efforts to select travel dates acceptable to winner. All prize details not specified in the Official Rules will be determined in Presenter’s sole and absolute discretion. Presenter will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Presenter's airline carrier of choice as detailed in the passenger ticket contract. Travel restrictions, conditions and limitations may apply.If in the judgment of Presenter air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for round-trip air travel at Presenter's sole discretion. In the event winner does not travel to the Ranch, that portion of the prize (including both the winner's and travel companion's airline tickets) will be forfeited and airline tickets canceled.Presenter will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. In the event a winner’s travel companion is deemed ineligible, winner may be given the opportunity to select an alternate travel companion, time permitting and as determined by Presenter in its sole discretion, or may be required to travel without a companion or forfeit the prize in its entirety at Presenter’s sole discretion.
In the event that the winner travels without a companion, the ARV of the prize is $2,985 and the difference will not be awarded.
The ARV for this prize is an estimate; the actual value may also vary based on airfare fluctuations and distance between departure and destination. Winner will not receive the difference, if any, between actual and estimated approximate retail value. Winners are solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to, additional ground transportation, in-room charges (e.g., mini-bar, room service, telephone, movies, etc.), meals and beverages, gratuities, travel upgrades, baggage fees, and personal incidentals.
Winners and guests may be required to provide a valid major credit card or some other acceptable form of payment, as determined in the Ranch’s sole discretion upon check-in and all in-room charges, telephone calls, meals, beverages, upgrades, amenities, personal incidentals and any other expenses charged to the winner’s room will be charged to that major valid credit card or deducted from the deposit provided.
Travel is subject to terms and conditions set forth in these Official Rules and those set forth by selected travel providers: availability and other material restrictions may apply. Winner and travel guest must travel on same itinerary. Presenter is not responsible for any fees or additional charges resulting from a winner’s or guest’s change to itinerary or accommodations. Presenter shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Presenter shall not be liable for any loss or damage to baggage. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Additional prize award details and travel information to be provided to the winner at the time of notification. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged.
Presenter is not responsible for any delay or cancellation of prize event due to unforeseen circumstances, or those outside of Presenter’s control. In the event, for whatever reason, any prize/Ranch event or activity is cancelled prior to, or during, the winner’s trip, the experience will not be awarded and Presenter will not provide any compensation or substitution for that portion of the prize. Winner and guest agree to comply with all applicable venue regulations in connection with the Ranch activities and events (if any). Presenter and the applicable venue representatives reserve the right to remove or to deny entry to winner and his/her guest who engage in a unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any event or activity or in any other objectionable behavior.
Other
Marlboro sweepstakes Ranch promotions will be running concurrently with this 2018 Marlboro Ranch Sweepstakes. Participants are limited to winning one Ranch Trip prize across all Marlboro Ranch promotions.
Winner acknowledges that the Released Parties (as defined below) have not made, nor are in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, merchantability, or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefor, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
For All Prizes: Odds of winning a prize depend on the number of eligible entries received during the Sweepstakes Period. No cash or other substitution, assignment or transfer of any prizes permitted, except by Presenter, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value. Winners are responsible for all federal, state and local taxes and fees associated with prize receipt and/or use. Prizes will be awarded "as is" with no warranty or guarantee, either express or implied, offered by Presenter.
Limit: (1) prize per person.
TOTAL ARV OF ALL PRIZES: $24,450.
