GRIZZLY PROVING GROUND GIVEAWAY OFFICIAL RULES

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

3. ELIGIBILITY: The Grizzly Proving Ground Giveaway (referred to herein as the “Giveaway”) is open to legal residents of the United States and the District of Columbia (excluding residents of Massachusetts, Michigan and Virginia) who are tobacco consumers age 21 or older at time of entry, who are registered users of www.mygrizzly.com. Employees of American Snuff Company, LLC (the “Sponsor”) and its subsidiaries, affiliates, advertising and promotion agencies, Ventura Associates International LLC (“Administrator”) and their immediate families and persons living in the same households are not eligible to enter or win. Giveaway is governed by U.S. law. Void in Massachusetts, Michigan, Virginia, Puerto Rico, other U.S. territories and possessions, and where prohibited by law. The Giveaway is intended for entry in the United States only. Do not enter if you are not eligible and located in the United States at the time of entry.
4. THE GIVEAWAY ENTRY PERIOD: Giveaway begins at noon (12:00:00 pm) Eastern Time (“ET”) on March 6, 2018 and ends at 11:59:59 am ET on April 17, 2018 (the “Giveaway Entry Period”). 1. HOW TO ENTER: You must be a registered user of www.mygrizzly.com (“Website”) to enter the Giveaway. If you are not a registered user, you can register for free by visiting the Website and following the instructions to register. Your mygrizzly.com account must be in good standing in order to be eligible to win any prize. Once you have registered, log on to the Website during the Giveaway Entry Period and follow the onscreen instructions to play the trivia game of this Giveaway by answering a multiple choice question (referred to hereafter as “Play”). The questions in the trivia game will be related to the weekly theme as stated above. Each registered user will have an opportunity to answer one (1) question per Day. Two (2) entries will be awarded into both the applicable Weekly Entry Period drawing and the Grand Prize drawing for each question answered correctly. One (1) entry will be awarded into both the applicable Weekly Entry Period drawing and the Grand Prize drawing if an incorrect answer was submitted. 2. Receipt of a Play occurs when the server hosting the Website records the submission resulting from an entrant clicking on an answer and Submit button. If you enter using a mobile device, standard data rates may apply from your carrier.
3. Use of automated processes and devices to submit entries are not permitted. Any attempt by any individual to Play more than the limit per Day by using multiple names or accounts or any other methods will void all of such individual’s entries. The Sponsor is not responsible for any changes or effects caused to entrant’s computer system or mobile device as a result of submitting any Play. In the event of a dispute over the identity of an entrant, entrant may be deemed to be the individual associated with the Website account used to submit the Play or the disputed entry may be disqualified, determined in the sole discretion of the Sponsor. 4. The Giveaway’s Administrator is an independent judging organization whose decisions as to the administration and the verification of winners are final and binding in all matters related to the Giveaway. Receiving a prize is contingent upon a potential winner’s compliance with these Official Rules.
5. VERIFICATION OF POTENTIAL WINNERS: All potential Weekly Prize winners will be randomly selected on or about May 2, 2018 from among all eligible entries received for an applicable Weekly Entry Period. Potential Weekly Prize winners may be required to complete and return an Affidavit of Eligibility, a Release of Liability, and a Publicity Release (“Affidavit”) within seven (7) days of date specified on prize notification in order to formally claim and receive the prize. All potential Grand Prize winners will be randomly selected on or about May 2, 2018 from among all eligible entries received during the Giveaway Entry Period and will be required to complete and return an Affidavit within seven (7) days of date specified on prize notification in order to formally claim and receive the prize. All potential winners will be notified by e-mail at the e-mail address used to register for the Website within three (3) business days of the drawing. At the sole discretion of the Sponsor or Administrator, prize forfeiture and/or the selection of an alternate winner may result from any of the following: i) an Affidavit or a prize notification is returned as undeliverable; ii) the Affidavit is not returned within the date specified on notification; iii) potential winner is otherwise found to be ineligible; iv) potential winner cannot accept or receive the prize for any reason; and v) any other non-compliance with these Official Rules. Attempts will be made to notify up to three (3) alternate winners for any unfulfilled prize; after which the unfulfilled prize will not be awarded. Each trip consists of: (a) round trip coach class air transportation for winner and guest to San Antonio International Airport from a major commercial airport near winner’s primary residence (as determined by Sponsor, in its sole discretion). Sponsor reserves the right to provide a $300 travel allowance in the form of a check in lieu of air travel if winner lives within a 200 mile radius of Uvalde, TX; (b) round trip ground transportation between airport and Ox Ranch for winner and guest; (c) three (3) night accommodations for winner and guest at a lodge/cabin of Sponsor’s choice (room and room tax only); (d) catered meals during the stay for winner and guest at Ox Ranch [breakfast/lunch/dinner]; (e) Ox Ranch All-Inclusive Hunting Package for winner and guest (which includes use of hunting equipment provided by Ox Ranch and may include activities such as: hog hunting, night safari, star gazing, bass/trout fishing, 4 wheeling, giraffe feeding, cave exploring, water activities, subject to availability) and up to $1,072.50 each worth of additional activities chosen by winner and guest from among the activities offered by Ox Ranch (which might include: jet skiing, skeet shooting, yoga, tank driving, and other offered activities, subject to availability); (f) a Welcome Package for the winner only consisting of items determined at the Sponsor’s sole discretion, valued at approximately $541; and (g) $3,500.00 spending money in the form of a check to winner only (which can also be used to pay any necessary hunting license fees/costs and to help offset some of the tax liability incurred from the trip). The winner and their guest are solely responsible for paying any applicable hunting license fees and associated costs for activities not included in the Ox Ranch All-Inclusive Package. Any and all expenses and incidentals not mentioned herein as being paid by Sponsor are winner and guest’s sole responsibility, including but not limited to tips; meals, snacks, and beverages (outside of or in addition to the catered meals provided by Sponsor); room service, souvenirs; local and long-distance telephone calls; laundry; insurance; equipment, other activities not mentioned herein; ground transportation between winner’s home and the airport; airport parking; baggage fees; medical fees and other personal expenses associated with the trip.
5. By accepting the trip, each winner and his/her guest represent and warrant that he/she is in good physical condition, appropriate to conduct the activities contemplated by the trip, and that he/she has no physical or other condition that may be aggravated or exacerbated by the physical activity necessitated by participating in the hunting activities. In addition, in order to participate in the hunting activity, each winner and his/her guest represent and warrant that he/she is eligible to obtain and use a hunting license as well as a shotgun or rifle under federal, state and local laws and regulations. Winners and guests may be required to provide additional information or documentation to prove his/her eligibility, including without limitation, proof of identity, age, height, weight, eye color, hair color, hunting license eligibility and U.S. residency. Guests must complete and return the Affidavit prior to travel. At the Sponsor’s discretion, winners and their guests may be subject to a background check. Sponsor reserves the right to accept or deny awarding the Grand Prize or a portion of the Grand Prize based on information or documentation submitted or the failure to submit required information or documentation or failure to pass the background check. 6. All winners and guests must meet all requirements of Ox Ranch and the applicable hunting company and must sign any forms and releases required by such company for participation. Winners and guests must follow all instructions and/or security procedures imposed during the trip including attire requirements, the hunting laws/regulations and any other applicable local laws. If hunting activity is not available due to inclement weather conditions, or after the trip commences the winner or guest is not able to participate in the hunting portion or any activity of the trip due to reasons such as but not limited to illness or physical impairment, etc., the Sponsor’s sole responsibility will be to award the remaining elements of the Grand Prize minus the hunting/activity portion of prize. Actual value of the trip prize depends on location of winner, fares and prices at time of booking. If actual value of trip is lower than the stated ARV, the difference will not be awarded.
7. Sponsor anticipates that the trip will take place on September 27-30, 2018, subject to availability and confirmation. Winners and guests must travel together on the same itinerary and on the dates specified by Sponsor or the prize will be forfeited without compensation. Travel arrangements must be made through Sponsor’s authorized agent. Government issued documentation is required for travel. Winners and guests are responsible for obtaining the proper travel documentation (for example, valid government issued photo/travel ID, etc.) prior to travel. Once trip is booked, no changes or cancellations will be accepted. No extensions or exceptions shall apply or be available. If, for any reason whatsoever, the winner cannot participate in the trip after all travel arrangements are made and paid for, then the prize will be forfeited in its entirety and Sponsor shall have no further obligation to the winner and/or his/her guest. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, or other transportation companies, or any other persons providing any of these services and accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage, personal belongings, or persons.

3. If you would prefer not to receive future mail or email communications from Sponsor, you may subsequently opt-out by calling 866-843-0636, or writing your name and address (and email address if previously provided to Sponsor) on a postcard and mailing to: Mail Manager-Remove, P.O. Box 834049, Richardson, TX 75083-4049. You may also log on to www.mygrizzly.com and make changes within your profile regarding the receipt of mail and email from Sponsor. By opting-out, residual information may nonetheless remain in our database and other records, which may not be permanently deleted.
4. LIMITATION OF LIABILITY: Sponsor is not responsible for: (i) lost, late, misdirected, non-delivered, damaged or illegible entries, e-mails, or other communications; or (ii) error caused by human and/or technological issue, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to user’s or any other person’s computer or mobile device related to or resulting from participating in the Giveaway. BINDING ARBITRATION: Any controversy or claim arising out of or relating to the Giveaway shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for the claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply North Carolina law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. If any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, or illegal or conflicting provision were not contained herein. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS SECTION SHALL BE IN THE USER’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION PROCEEDING.
