:cry: :cry: Ok, so my DH has a good job. He is garnished for $200/wk for child support. No problem. NOW a credit card co. (run up in his name by his ex) has attached a 2nd garnish for $159/wk. Right at Christmas with 4 kids to buy for. He thought they couldn't garnish him becuz CS is already taking the max allowable. HELP! Is there anything I can do to stop this garnishment? Would filing bankruptcy stop it? They won't work out a payment plan with us. This came up out of the blue. It seems so unfair :cussing:. These 2 garnishments = $1400 a month from his income. He's gone from 450-500/week to 240. I only get 700 per month in disability. I'm afraid we're not gonna make it thru this. Sorry to whine and seem like I feel sorry for myself. I'm just so distraught and don't have any idea what to do or how to fix this. All advice is appreciated. Thank you all!!

Title III also protects employees by limiting the amount of earnings that may be garnished in any workweek or pay period to the lesser of 25 percent of disposable earnings or the amount by which disposable earnings are greater than 30 times the federal minimum hourly wage prescribed by Section 6(a)(1) of the Fair Labor Standards Act of 1938. This limit applies regardless of how many garnishment orders an employer receives. The federal minimum wage is $5.85 per hour effective July 24, 2007; $6.55 per hour effective July 24, 2008; and $7.25 per hour effective July 24, 2009.

In court orders for child support or alimony, Title III allows up to 50 percent of an employee's disposable earnings to be garnished if the employee is supporting a current spouse or child, and up to 60 percent if the employee is not doing so. An additional five percent may be garnished for support payments over 12 weeks in arrears. The restrictions noted in the preceding paragraph do not apply to such garnishments

That seems like alot to take out. im so sorry this is happening to you. I wouldnt be to quick to fill bankruptcy. it effects more than you might think.
 
Why would his ex still have a credit card in his name. You need to contact the credit card company as well as all three of the major credit reporting companies to make sure his name is removed from any account that isn't his. You can run a report and it will show anything open in his name. So sorry this is going on. What I wouldn't do to get rid of some of these crazy ex's. (we have one to play with too and it's not fun) Good luck and make sure you stop her from anymore funny business
 
Oh my, I was going to ask the same thing. Why would his ex still have a credit card in his name? :scratch: Oh boy, that's just asking for trouble!! :nono: I really don't know what you can do. Since his name is on it, he is responsible for it. Garnishing wages varies from state to state. My ex was getting just about half of my social security disability money at one time in PA; and, no, they don't care whether or not you can live on what you're left with!! :cry:

If you need advice/help on how to tremendously cut your cost of living just pm me. I know how to get just about everything for next to nothing.

Praying helps too!! :)

As for bankruptcy, that's something you really need to avoid.
 
leisa10 I am sorry to hear about this and I wish I had some advice but really I don't accept like lidarkside try to avoid bankruptcy. I hope it all works out and I will be praying for you guys. :love:
 
Hun Get into court as soon as possible(small claims) 49.95 borrow the money with all paper work and documentation of garnishment & credit card bills between the ex & your man & show a judge she did a NONO after the relationship was over. :nono: She CANNOT do that legally if the relationship was over . Judge will order her to pay it to you, If she does not you can put a wage garnishment on her.!!!Gunny Hunny
 
:wave: Also Ms Leisa DO NOT NOT NOT ever file bankruptcy EVER in your name or his name... It will stay on your credit reports for 10 years to life & ruin your credit. for LIFE !!!. a bad judgement is better than a BANKRUPTCY! It will not STOP or help you with a garnishment. Officer Gunny Hunny
 
Hey Leisa, I am anxious to know how you are doing with trying to work this out. I know you will have to put a lot of time in to get it worked out but it can be done. A friend of mine went thru the exact same thing except for hers was the house and the boat that they bought together. She finally got it straight. Keep your chin up.
