Presenter reserves the right to select fewer than the stated number of Finalists, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions. Presenter will not disclose judging scores.
Finalists will be notified via the email address associated with his/her profile on www.freshcope.com on or around July 15, 2019
b. Voting Phase: During the Voting Phase, the Finalists' Submissions will be posted in an online poll on https://www.freshcope.com for voting. If you are not a registered user, go to https://www.freshcope.com and follow the instructions to register. When you register on https://www.freshcope.com, you will be assigned a unique 9-digit customer number (herein "CCN") and will select, or may be assigned, a user ID that will be associated with your account. By registering at https://www.freshcope.com, you agree to be added to the Copenhagen mailing list. Once you have registered, log on to https://www.freshcope.com and click on the link to the "Copenhagen Masters in the Making Contest" tile.

Limit: Each person may vote (1) time per day during the Voting Phase.

Multiple votes received from any person or email address in excess of the stated number will be void. Any attempt by any Finalist or voter to obtain votes by any fraudulent or inappropriate means, including without limitation, offering prizes or other inducements to members of the public as determined by Presenter in its sole discretion, by using any automated program, by using multiple/different email addresses, identities, registrations and logins, or any other methods, will void those votes for the Finalist's Submission and Finalist may be disqualified as determined by Presenter in its sole discretion. Presenter reserves the right, in its sole discretion, to select an alternate winner should the voting appear to have been tampered with or manipulated in any way.
8. Winner Requirements: Potential winners will be notified via the email address associated with his/her profile on www.freshcope.com on or around July 23, 2019. If an email address is not on file, winner will be notified via mail. Each potential winner will be required to sign and return a Declaration of Compliance, Liability and Publicity Release (“Declaration”). Declarations will be sent to the email address associated with the profile unless the potential winner requests to receive a Declaration via mail or an email address is not on file. If an email address is not on file, the potential winner will receive the Declaration via mail. Administrator must receive the Declaration within five (5) days of the date notice or attempted notice is sent in order to claim his/her prize. If a potential winner of any prize cannot be contacted, or fails to sign and return the Declaration or provide any other requested information within the required time period (if applicable), prize is returned as undeliverable, or prize is undelivered based on missing information (including, but not limited to, a valid address and valid phone number), or does not comply with these Official Rules, potential winner forfeits the prize. If a potential winner is disqualified for any reason, the prize will not be awarded to a runner-up. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Promotion.
POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY PRESENTER, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

10. Release: By acceptance of any prize, winners agree (and agree to confirm in writing) to release and hold harmless Presenter, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or useor misuse of any prize, or any claim or cause of action based on publicity rights, defamation or invasion of privacy. The Released Parties are not responsible if any prize cannot be awarded due to cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or terrorism.
11. Publicity Acceptance of any prize shall constitute and signify each winner’s agreement and consent (which will be confirmed in writing on request of Presenter) that Presenter and its designees may use the winner’s name, city, state, likeness, photo, Submission, and/or prize information in connection with the Contest for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.
12. Ownership of Submission: Each winner shall irrevocably grant, transfer, convey and assign to Presenter the entirety of the rights in and to the Submission and all renewals and extensions of copyright, and the right to secure copyright registrations thereto in perpetuity including, without limitation, the rights to use the Submission for any and all purposes in any and all media whether now known or hereafter developed, on a worldwide basis, in perpetuity. Each winner accepts and acknowledges that Presenter shall not be obligated to use the Submission and that Presenter in its sole discretion shall have the right to refrain from using the Submission. Presenter shall not incur any liability whatsoever to the extent Presenter chooses to refrain from any exploitation of its rights hereunder. Each winner will indemnify Presenter, Released Parties, and any licensee of Presenter against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these terms.
13. General Conditions: Presenter reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Contest, as determined by Presenter in its sole discretion. If terminated, Presenter may, in its sole discretion, determine the winners from among all non-suspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Presenter, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Presenter reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Presenter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
14. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or useor misuse of any prize. Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Submission.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS CONTEST, INCLUDING THE WEBSITE ASSOCIATED WITH THIS CONTEST AND ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
15. Nature of Relationship/Waiver of Equitable Relief: Each entrant understands and acknowledges that Presenter has wide access to ideas, designs, and other materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of Presenter’s use of any such similar or identical material. Each entrant acknowledges and agrees that the Presenter does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submission. Finally, each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of Presenter’s actual or alleged exploitation or use of any Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Submission or any material based on or allegedly based on the Submission, and the entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.
16. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for New York or an appropriate New York State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Presenter in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
